WHAT IS THE EMPLOYER RETENTION CREDIT?
The Employer Retention Credit (ERC) is a tax credit that was created as part of the CARES Act in response to the COVID-19 pandemic. The credit is designed to help employers keep their employees on payroll during the economic downturn caused by the pandemic. The credit is available to employers who have experienced a significant decline in gross receipts or have suspended or significantly reduced their trade or business activities as a result of government orders related to the COVID-19 pandemic.
WHAT ARE SOME KEY POINTS TO THE ERC?
- The Employer Retention Credit (ERC) is a tax credit created as part of the CARES Act in response to the COVID-19 pandemic to help employers keep their employees on payroll during the economic downturn caused by the pandemic.
- The credit is available to employers who have experienced a significant decline in gross receipts or have suspended or significantly reduced their trade or business activities as a result of government orders related to the COVID-19 pandemic.
- The credit is equal to 50% of qualified wages, up to a maximum of $5,000 per employee for the entire year 2020. Qualified wages are wages paid to an employee, including health plan expenses, during a period in which the employer’s operations were fully or partially suspended as a result of a government order or the employer experienced a significant decline in gross receipts.
- To be eligible for the ERC, the employer’s gross receipts must be less than 80% of the gross receipts for the same calendar quarter in the prior year.
- The ERC can be claimed against certain employment taxes, and if the credit exceeds the employer’s employment tax liability, the excess can be refunded to the employer.
- Employers can claim the credit for the first two quarters of 2020 and the credit is also available for employers who received a Paycheck Protection Program loan, but the credit and the loan cannot be claimed for the same expenses.
